On rescheduling obligatory delivery of information on separate agreements to repository
On 26 May 2014, the Ministry of Justice of the Russian Federation performed state registration of Bank of Russia Ordinance No.
The Ordinance is aimed at rescheduling obligatory delivery of information on agreements other than repurchase agreements or currency swap agreements made under the terms of general agreement (unified agreement) to self-regulating organisation of professional securities market participants, clearing organisation or exchange (the repository). Deadline for obligatory delivery of information on all types of agreements other than repurchase agreements and currency swap agreements to the repository is rescheduled for 1 January 2015.
The Ordinance is a revision of FFMS of Russia Order No. 11-68/pz-n dated 28 December 2011 ‘On the Procedure of Keeping the Register of Agreements Made under the Terms of General Agreement (Unified Agreement), Delivery of Information Needed to Keep the Specified Register and Information from the Specified Register and Delivery of Register of Agreements Made under the Terms of General Agreement (Unified Agreement) to the Federal Executive Authority for the Securities Market’.
The Ordinance also provides for a possibility of rendering repository services to Russian participants in relation to cross-border transactions irrespective of conclusion of repository services agreement with foreign participant by the repository. In such case Russian participant and foreign participant must determine that the reporting party is the Russian party or the third party.
